Prequalification Terms and Conditions

Prequalification Requests. Applied Data Finance, LLC d/b/a Personify Financial, and its affiliates[1], service providers or agents and their successors and assigns (collectively, "we", "us" "our," or "Company") provides you with a platform (the "Platform") through which you may submit prequalification inquiries for review by select creditors and other financial service providers with whom Company has a relationship (the "Participating Creditors"). 

When you submit your information through the Platform, it will be reviewed to determine whether you may be eligible for: (1) a loan made by Personify Financial, where available; (2) a loan made by First Electronic Bank, a Utah-chartered industrial bank located in Salt Lake City, Utah, where available, through the Personify platform; or (3) offers from Participating Creditors. Not all applicants will qualify, and submitting your information does not guarantee a loan offer or loan approval. Rates, terms, and licensing information vary by state and by lender. By agreeing to and accepting these Prequalification Terms and Conditions, you direct us to send your information to Participating Creditors, as we may choose, to determine if you prequalify for credit, and you direct each of them to notify us regarding any offer for which you may prequalify (as applicable).  You authorize Company and Participating Creditors to share your prequalification request, application and other information you may provide with the Platform provider to determine if you prequalify for credit and/or to facilitate any extension of credit offered to you. Each Participating Creditor may pay Company a fee for Participating Creditor’s participation with the Platform.

YOU ALSO EXPRESSLY AGREE AND UNDERSTAND THAT:

  • EXCEPT IN GEORGIA, THE COMPANY HELPS PROSPECTIVE BORROWERS FIND LENDERS AND IS NOT ITSELF A LENDER;

  • COMPANY MAY RECEIVE COMPENSATION FOR ITS SERVICES FROM LENDERS;

  • THERE MAY BE NO LENDER THAT WILL OFFER CREDIT TO PROSPECTIVE BORROWERS IN THE AMOUNT OR ON THE TERMS THEY DESIRE;

  • PROSPECTIVE BORROWERS MAY NEED TO SUPPLY ADDITIONAL INFORMATION TO A LENDER TO COMPLETE THE PROSPECTIVE BORROWER'S APPLICATION AND THIS INFORMATION MAY NEED TO BE SENT VIA FAX OR EMAIL; AND

  • YOUR INFORMATION MAY BE SHARED WITH ALL OF THE PARTICIPATING CREDITORS.

Prequalification Inquiries are Not Credit Applications. The prequalification inquiries are not credit applications. Instead, they are an opportunity for Participating Creditors to provide information to you so you can decide whether to apply for credit from such Participating Creditors. Any application for credit will be finalized between you and the Participating Creditor.

Use of the Platform. The Company makes no representations or guarantees that use of the Platform will result in an offer of credit. The Platform is a tool through which you may submit prequalification inquiries. It is in the sole discretion of any Participating Creditor to extend credit. 

Your Representations. By saving your information with and/or submitting a prequalification inquiry through Company, you represent that:  

  1. You are eighteen (18) years of age or older and are of the age of majority in your jurisdiction; 

  2. The information you have provided is current, accurate, and complete;

  3. Your use of the Platform will not violate any law in any applicable jurisdiction; and

  4. You will not engage in any conduct that will impede, impair or interfere with the functioning of the Platform. 

Platform Access. You agree that only you will use any account set up in your name, and that you will not facilitate unauthorized access to your account. You agree that you are responsible for all activities that occur in connection with your account. If you believe that your account has been compromised or is no longer secure, you agree to immediately notify Company. 

Participating Creditors. In connection with the Platform, Company will request that one or more Participating Creditors make a specific extension of credit directly or indirectly to you. The names and addresses of the Participating Creditors with which we may share your information are as follows:

State Disclosures Related to Prequalification 

ALL APPLICANTS INCLUDING CALIFORNIA AND VERMONT RESIDENTS: You authorize Company and any Participating Creditor to obtain and verify information about you that Company or Participating Creditors may deem necessary or appropriate in evaluating your prequalification request. If your prequalification request is approved and an extension of credit is granted, you may be required to authorize Company and the Participating Creditor granting the extension of credit to obtain additional consumer reports and other information about you in connection with reviewing your application or your account, increasing the available amount of credit on the account (if applicable), taking collection on the account, or for any other legitimate purpose. 

THIS IS A LOAN PREQUALIFICATION REQUEST ONLY.  COMPANY IS NOT THE LENDER EXCEPT IN GEORGIA. INFORMATION RECEIVED WILL BE SHARED WITH ONE OR MORE THIRD PARTIES IN CONNECTION WITH YOUR PREQUALIFICATION REQUEST. THE LENDER MAY NOT BE SUBJECT TO ALL OF THE LENDING LAWS OF YOUR STATE OF RESIDENCE (E.G., IF THE LENDER IS A BANK). THE LENDER MAY BE SUBJECT TO FEDERAL LENDING LAWS. 

California Residents: If you are married, you may apply for a separate account. 

Ohio Residents: The Ohio laws against discrimination require that all creditors make financing equally available to all credit worthy customers, and that credit reporting agencies maintain separate credit histories on each individual upon request. The Ohio civil rights commission administers compliance with this law. 

Rhode Island Residents: Consumer reports may be requested in connection with this application.  

Wisconsin Residents: No provision of any marital property agreement, unilateral statement under Section 766.59 of the Wisconsin statutes or court order under section 766.70 adversely affects any Participating Creditor's interest, unless Company or the Participating Creditor, prior to the time financing is granted, is furnished a copy of the agreement, statement or decree or have actual knowledge of the adverse provision when the obligation to the Participating Creditor is incurred. If married, you understand that the Participating Creditor must inform your spouse if a financing account is opened for you.
